What Are Audio Rights? Ask License Audio Rights Law Firm, Perdomo Law in Manhattan New York, NY

What Are Audio Rights?

Ownership privileges are the given rights a person obtains when they create, draw, sing, or make something. Many people understand these rights as intellectual property privileges.

When a person wants to sell or let someone buy the right to use the creative work, a contract is necessary to protect both parties. Usually, the party with an interest in using the audio applies for a license to use it. There are a few types of audio licenses available.
Types of Licenses for Using Audio Content
  • Sync License - This license allows the holder to use cover versions of songs in games and audio productions. A person or publisher can combine this license with a master key to get access to the recording version of songs. Then, the license holder can use them in movies, television productions, and other reproductions.
  • Blanket Coverage - This license comes from a music licensing firm like ASCAP, the American Society of Composers, Authors, and Publishers. This certification requires an annual payment to the license holder. The licensee gets the right to use any song in the company database as much as they like as long as the membership payments are current.
  • Master Use - This form of licensing comes from the production label. They alone are the ones who have the right to offer permission to use a recording version of a particular audio file. To use these items in games, it is important to obtain this license along with synchronization rights.
  • Reproducing License - This licensing type is commonly seen in audio download agreements. People can purchase song rights by buying a download on popular music sites. The person pays for the song, and a portion of the payment goes directly to the artist in the form of royalties. These payments can be a one-time fee for each download, or the artist can ask for a particular percentage of each payment. Record labels purchase these licenses to create CDs and other audio recordings of songs and books.
  • Book Recordings - Most books do not get an audio recording for whatever reason. Whether a person seeks to publish a recording or not is a personal decision. However, there are rights to cover these items should the person decide to add an audio version.
Does the Publisher or Artist Hold the Rights to Audio Content?

Usually, the publisher will own the license to sell audio songs and books. Most contracts dictate the entity reproducing the content has the right to the song or book. Although another person owns the right to sell copies of the audio recording, the artist or creator retains the right to a portion of the sales.

When there are disputes between parties regarding audio content or reproduction of such works, legal professionals can help solve the problem amicably. Whether a person needs help because they are not getting the money they feel they should get, or a license holder is misusing the content, Francelina M. Perdomo Klukosky knows how to sort out the problem.

When Do the Rights Revert Back to the Artist?

Book recordings are usually the property of the book publisher. There is one situation where this is not the case. If a publisher uses a standard contract, and he or she does not make a recording of the book in a short period, the rights go back to the author. This transaction may occur in as little as one, two, or three months' time. However, it is important to talk with your licensed audio rights attorney to be sure the clause is in a specific recording contract.
